1. Agreement to Terms
These Terms and Conditions ("Terms") govern access to and use of the Saboraa platform and related services.
By creating an account or using the Services, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use the Services.
2. Description of Services
Saboraa provides software and related services for restaurant management, including but not limited to:
- Restaurant website management
- Website content creation
- Menu management
- Reservation management
- Staff management
- Staff scheduling
- Attendance and time tracking
- Reporting and analytics
- Multi-location management
- Domain connection services
3. Eligibility
You must be at least 18 years old and legally capable of entering into contracts to use the Services.
If you use the Services on behalf of a business, you represent that you have authority to bind that business.
4. User Accounts
Users are responsible for:
- Maintaining account security
- Protecting passwords and credentials
- Managing user access permissions
- Ensuring account information remains accurate
5. Subscription Plans and Billing
Saboraa may offer Free, Pro, Enterprise, and other subscription plans.
Paid subscriptions may be billed monthly or annually.
Fees are non-refundable except where required by law.
You authorize us to charge applicable subscription fees using your selected payment method.
6. Trial Periods
If a free trial is offered, access will automatically expire at the end of the trial period unless upgraded to a paid subscription.
We reserve the right to modify or withdraw trial offers at any time.
7. Customer Data
Customers retain ownership of all data submitted to the platform.
Customers are solely responsible for:
- Data accuracy
- Compliance with applicable laws
- Obtaining required consents from employees, customers, and other individuals
8. Acceptable Use
Users may not:
- Use the Services for unlawful purposes
- Upload malicious software
- Attempt unauthorized access
- Interfere with platform operations
- Circumvent security measures
- Infringe intellectual property rights
- Use the Services to distribute spam
9. Availability of Services
We aim to provide reliable access to the platform.
However, the Services are provided on an "as available" and "as is" basis.
We do not guarantee uninterrupted or error-free operation.
Scheduled maintenance, upgrades, and unexpected outages may occur.
10. Intellectual Property
The Saboraa platform, software, branding, designs, content, and related materials remain the property of Saboraa or its licensors.
No ownership rights are transferred to users.
Customers receive a limited, non-exclusive, non-transferable license to use the Services during an active subscription.
11. Third-Party Services
Certain functionality may rely on third-party providers, including:
- Payment processors
- Domain registrars
- Email services
- Hosting providers
12. Limitation of Liability
To the maximum extent permitted by law, Saboraa shall not be liable for:
- Indirect damages
- Consequential damages
- Lost profits
- Lost business opportunities
- Loss of data
- Business interruption
13. Indemnification
Users agree to defend, indemnify, and hold harmless Saboraa, its officers, employees, and affiliates from claims arising from:
- User content
- Violation of these Terms
- Violation of applicable laws
- Misuse of the Services
14. Suspension and Termination
We may suspend or terminate access if:
- These Terms are violated
- Fees remain unpaid
- Use presents a security risk
- Required by law
15. Changes to the Service
We may modify, add, remove, or update features, pricing, and functionality at any time.
Where required, reasonable notice will be provided.
16. Changes to these Terms
We may revise these Terms from time to time.
Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
17. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Spain, without regard to conflict of law principles.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain.
